1. ACCEPTANCE OF TERMS

  • Agreement: These Terms of Use (“Agreement” or “Terms”) constitute a legally binding agreement between you (either individually or on behalf of an entity, “you” or “User”) and Magic Play Yazilim Limited Sirketi (“Magic Play”, “Company”, “we”, “us”, or “our”), governing your access to and use of our website https://magicplay.io, as well as any related media form, web application, mobile application, or service offered through any such channel (collectively referred to as the “Platform” or “Site”). By accessing or using the Platform, you confirm that you have read, understood, and agreed to be bound by these Terms, all applicable laws and regulations, and that you are solely responsible for compliance with any local laws. The content and materials on the Platform are protected by copyright and other applicable intellectual property laws.

  • Important Notice: These Terms form a binding legal agreement between you and Magic Play with significant legal consequences. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE PLATFORM AND MUST IMMEDIATELY DISCONTINUE USE. These Terms become effective upon your acceptance by clicking the “AGREE & CONTINUE” button (the “Effective Date”) during account registration or use of the Platform.

  • Included Policies: This Agreement incorporates by reference our Privacy Policy and Community Guidelines, which form an integral part of these Terms.

  • Modifications to the Platform: We reserve the right to change, modify, or remove content or features of the Platform at any time, at our sole discretion, in order to maintain or improve the functionality, security, or compliance of the Platform. We are under no obligation to provide prior notice or updates and are not liable to you or any third party for any changes, suspensions, or discontinuations of the Platform or any of its features.

  • Changes to the Terms: Magic Play may revise these Terms at any time. By continuing to use the Platform, you agree to be bound by the most recent version. If changes are made, we will update the “Last Updated” date at the top of the Terms and may notify you via the Platform. Your continued use of the Platform following such changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

2. ACCOUNT

  • Eligibility to Register: You may not access or use the Platform if (a) you are legally restricted from entering into binding agreements, or (b) local laws—either in the Republic of Türkiye or your country of residence—prohibit your use of the Platform. This service is strictly available only to individuals who are 18 years or older. Users under 18 are not permitted to register or interact with the Platform.

    By creating an account, you confirm that you are not located in a region sanctioned by the Turkish government, nor listed on any governmental restriction or embargo list.

    If you’re registering on behalf of a business or another organization, you guarantee that you have the authority to legally represent and bind that entity to these Terms. All references to “you” throughout this agreement will then apply to that entity as well.

  • Account Setup: Access to various features may require account registration, and only one account per person is allowed. You must submit accurate and current information—such as your email address and display name—and keep it updated. Any inaccuracies may result in suspension or termination of your access.

  • Account Transfers: Transferring, sharing, or selling your account is not allowed. If your account is deactivated or banned, you may not create a new account under another name or impersonate another individual. Attempting to do so may lead to legal consequences.

  • Username Policy: We reserve the right to remove or alter any display name at our discretion if it’s deemed offensive, misleading, or inappropriate.

  • Guest Users: We may allow limited “guest” access with certain restrictions. Full functionality typically requires a registered account. Unless otherwise specified, these Terms also apply to guest users.

  • Your Responsibilities: By accessing the Platform, you agree to:

    • Provide only truthful and complete information;

    • Maintain up-to-date account details;

    • Follow all rules stated in these Terms;

    • Refrain from unlawful or unauthorized activities;

    • Secure your login credentials and be responsible for your account’s use.

  • Notifications: We may send you messages related to your account or usage of the Platform (e.g., verification or security alerts). These may be delivered to the email address you provided.

  • Closing Your Account: You may permanently delete your account at any time. Doing so will erase all your data—including personal profile details—from our system. Keep in mind that interactions such as messages you’ve sent to others may remain visible. Once you confirm deletion, it is irreversible.

3. SERVICES

  • Service Description: The services offered by Magic Play through its web and mobile applications (collectively referred to as the “App”) include features such as game downloads, reward-based activities, and user engagement tools.

  • Display of Other Apps: In certain cases, we may show you additional apps to help deliver personalized game recommendations. You can manage this setting within the app.

  • Playtime Definition and Limitations: Within our ecosystem, “playtime” is defined as the duration during which a player is actively engaged with the game—such as navigating menus, participating in missions, or making in-game decisions. Simply having the app open or watching ads does not count as playtime unless there is active interaction.

    The following do not qualify as playtime:

    • Idle Sessions: Leaving the app running without interaction;

    • Ad Viewing: Watching ads, whether incentivized or not, without gameplay engagement.

  • “Magic Play+” Features:

    • Ad-Free Mode: Ad-free functionality applies only to the Magic Play+ interface. Some ads in games may still be present, and we are not responsible for those.

    • Instant Rewards: Coins and rewards earned may be paid out within 7 days of qualification. We reserve the right to review and deny any payout, which may require up to 72 hours in special cases.

    • Cashback Amounts: The calculation of cashback coin values is entirely at Magic Play’s discretion.

    • Bonus Coin Earnings: Additional coin bonuses may be granted, also at our sole discretion.

  • Reward System: Magic Play rewards users with “Coins” for engaging actions like launching games, writing reviews, or using features of listed games. Coins reflect real-time activity, not passive use. Coins may be redeemed for items such as digital gift cards, subject to availability and terms.

    Unclaimed Rewards: If rewards are not claimed within 15 days, they may expire and become forfeited. Claims must be made via the registered email; other emails will be rejected.

    Please note:

    • No Cash Alternatives: Rewards can’t be exchanged or refunded unless legally required.

    • Designated Redemption: Rewards are valid only at specified merchants or platforms.

    • No Responsibility: Magic Play isn’t liable for lost, stolen, or defective rewards—except in cases of gross negligence or willful misconduct. We reserve the right to deactivate accounts suspected of abuse.

  • Contests and Challenges: From time to time, Magic Play may offer contests or in-app challenges. Specific eligibility and rules will be stated in each contest’s terms. We reserve the right to amend or cancel them at any time.

  • Third-Party Content: Our services may include or link to third-party services, which you use at your own risk. We do not guarantee the reliability or quality of any third-party content or advertising.

  • Invite Friends Feature: Magic Play may offer referral programs where users earn rewards for inviting others. Each program’s specific requirements will be detailed within the App.

4. USER BEHAVIOR GUIDELINES

We are committed to creating a positive, fair, and secure gaming experience for all our players. These rules are designed to ensure honest gameplay, meaningful leaderboards, and genuine competition. By using the Platform, you agree to actively participate in accordance with these expectations and acknowledge that violations may lead to disciplinary actions.

  • International Compliance and Export Law: Magic Play operates under Turkish jurisdiction. Those accessing our Platform from outside Türkiye do so at their own discretion and are responsible for adhering to local regulations. Products and services are intended for lawful use only, and any software provided by Magic Play must not be downloaded or re-exported in violation of Türkiye’s export restrictions.

  • Unfair Advantage and Exploits: Gaining an edge through dishonest or manipulative means is strictly forbidden. This includes exploiting bugs, using unauthorized features, or attempting to manipulate gameplay outcomes. Users must engage in good faith and maintain a respectful, fair environment for others. Violations can result in account penalties or permanent bans.

  • Social Features Conduct: Our social tools allow users to communicate and engage with others. All users must follow our Community Guidelines when using these features. Violations may result in partial or full restriction from social interactions within the Platform.

Account Usage Rules

  • Single Account Policy: Each person is permitted to maintain only one active account. Using more than one or transferring accounts is not allowed.

  • Reward Redemption: Reward claims must be submitted through the email address linked to the account. Requests from other email addresses will be rejected.

Prohibited Software

Use of any of the following tools during gameplay is strictly forbidden and may lead to immediate account suspension:

  • Auto-clicking Tools: Software that automates inputs or simulates play is not allowed.

  • Emulators: Accessing the Platform through emulation may result in a permanent ban.

  • Game-Hacking Tools: Modifying the game’s content or unlocking features through unofficial means is a violation.

  • Temporary or Disposable Emails: Using temporary emails for account creation may result in rejection or removal.

  • Rooted or Jailbroken Devices: Accessing the app from rooted or modified devices may lead to denial of service or redemption restrictions.

IP Address and Network Security

  • VPN and Proxy Usage: Any attempt to access the Platform using proxies, VPNs, or automated traffic tools (e.g., bots) is not permitted. These methods are viewed as manipulation and may trigger bans or other security actions.

  • Multi-Device IP Limitations: Our system is designed to allow a maximum of three devices per IP address to prevent abuse. Exceptions require special approval. Breaching this limit may be seen as suspicious activity and result in account penalties.

    • Device Monitoring: Our systems monitor IP activity and may flag accounts for investigation if multiple devices exceed the allowed limit.

    • Manual Review: In cases like school networks or internet cafés, users must request authorization from our team in advance.

By continuing to use Magic Play, you confirm that you accept these rules and agree to abide by our fair play policies. We reserve the right to enforce these terms to uphold integrity and a positive community experience.

 

PROHIBITED CONDUCT

By using the Services, you agree not to engage in any behavior that would violate these terms or infringe on the rights or safety of others. Specifically, you agree not to:

  • Post or share unsolicited promotional material, including spam, pyramid schemes, or any form of mass marketing.

  • Share content that is offensive, sexually explicit, violent, abusive, harassing, defamatory, or otherwise inappropriate as determined by Magic Play.

  • Harass, threaten, bully, or demean any individual or group.

  • Share materials that promote violence, encourage hatred, or put others at physical or emotional risk.

  • Publish or request sexual content from individuals under the age of 18, or engage in any conduct that exploits or endangers minors.

  • Violate laws related to the protection of children or distribute content that is discriminatory, hateful, or offensive based on race, ethnicity, religion, gender, disability, or similar traits.

  • Access or interact with the Platform using bots, scripts, or unauthorized automation.

  • Use the Platform for illegal or unapproved purposes, or to spread content that breaches applicable laws or these Terms.

  • Attempt to decompile, hack, reverse-engineer, or replicate our software or services.

  • Use automated tools (e.g., spiders, bots, scrapers) to extract content or data from the Platform.

  • Launch any action that interferes with or disrupts the normal functioning of the Platform, including violating technical policies or bypassing system limitations.

  • Share content that is abusive, inappropriate, or violates the rights of others, even if that content was uploaded by someone else.

  • Attempt to access or distribute another User’s personal data without their explicit consent.

  • Pretend to be another user or misrepresent your identity or affiliation with a company or person.

Technical Restrictions and Unlawful Uploads

You must not upload or transmit any content that:

  • Violates contractual agreements or legal obligations.

  • Contains malicious software (e.g., viruses, worms, or Trojan horses) or attempts to damage hardware, networks, or telecommunications.

  • Disrupts the Platform’s service or interferes with any other user’s access or enjoyment.

  • Collects personal data (like names, addresses, or email addresses) without permission.

  • Is designed for phishing, fraud, or criminal activities, or attempts to gain unauthorized access to data or systems.

Magic Play reserves the right to take legal action or terminate access if these rules are violated. This may include suspension, permanent removal, or reporting to legal authorities.

 

5. PAYMENTS AND BILLING

By using or subscribing to any Services offered through our Platform, you agree to pay all associated fees based on the pricing and billing methods presented at the time of purchase. The payment method you choose during checkout will be used for billing, and refunds (if applicable) will follow relevant legal regulations as described on the corresponding sales page.

You are responsible for ensuring that the payment and account information you provide is accurate and up to date. This includes your email address, payment method, and card expiration date. Any changes to this information must be updated promptly so we can complete transactions and reach you if needed. Purchases made through the Platform may be processed using online billing services. Prices are set in U.S. dollars unless otherwise specified. If a third-party service provider processes the payment, the amount may be converted into your local currency and could be subject to their own applicable charges.

All fees must be paid in full at the time of purchase, based on the most current pricing. If your purchase involves recurring payments, you authorize us to charge your payment method at the defined intervals without needing further approval for each billing cycle. You must notify us if you wish to cancel any recurring services.

We may rely on external payment platforms (such as Apple App Store, Google Play, PayPal, Stripe, and others) to handle billing transactions. These platforms have their own terms and privacy policies, which you must agree to when using their services. Magic Play disclaims responsibility for any issues or liabilities arising from third-party payment processors.

Magic Play reserves the right to change prices, correct billing errors, or revise terms related to payment at any time—even after you’ve submitted a payment. We may also reject or cancel any orders if necessary. If you are on a recurring payment plan and we make changes to our prices or services, those changes may take effect immediately through your selected payment provider, without additional notice.

 

6. TERM AND TERMINATION

Agreement Duration

These Terms remain in effect while you maintain an account or continue using our Services. If your use of the Services ends for any reason, specific provisions outlined here will still remain applicable beyond termination.

Once your account is closed or you uninstall the app, you must stop accessing or using any part of the Services.

Certain clauses—such as those covering “Payment & Fees,” “Intellectual Property,” “No Warranty,” “Limitation of Liability,” “Indemnity,” “Force Majeure,” “Entire Agreement,” “Headings,” and “Governing Law & Language”—will continue to be enforceable even after your account is terminated.

Termination Conditions

  • By the User: You may stop using the Service at any time by deleting your account or uninstalling the application.

  • By Magic Play (at its discretion): We reserve the right, without prior notice or obligation, to restrict, disable, or remove your access to the Platform at any time, for any reason or no reason, including (but not limited to) violations of our Terms, laws, or community rules. This may include blocking access from specific IP addresses or removing content you’ve uploaded. Termination by Magic Play does not exempt you from paying any outstanding amounts owed.

  • Due to Inactivity: If your account remains unused (e.g., no logins, redemptions, or activity) for 180 consecutive days, it may be considered inactive and deleted without warning. Any associated rewards, coins, or sign-up bonuses may be forfeited.

  • Due to Terms Violations: We may, at our discretion, limit access to the Services or deactivate your account immediately if we suspect you have violated these Terms or infringed on others’ rights, including intellectual property. Any remaining coins or rewards may be lost and will not be restored.

  • Fraudulent or Underage Accounts: Accounts found to be involved in fraudulent activity or created by users under the age of 18 may be terminated. Examples include (but are not limited to):

    • Installing the app from unauthorized sources,

    • Using fake or stolen credentials,

    • Engaging in manipulative or deceptive behavior,

    • Using tools that simulate engagement,

    • Gaining coins or rewards in dishonest ways.

  • Device Use and Account Switching: Users are permitted to access their account using one device at a time. Device changes are allowed but may be restricted to one change every 30 days. Frequent switching or unusual patterns could trigger review or account limitations.

7. PERSONAL DATA HANDLING – PRIVACY NOTICE

Magic Play is committed to respecting and protecting your privacy.

We collect and process information about your device and how you use our services in order to verify account eligibility, distribute rewards, manage campaigns, and resolve issues. Magic Play acts as an independent data controller under relevant legal frameworks.

When you use our services—such as playing games, earning Units, or joining our Rewards Program—you consent to the processing of gameplay and activity data. If you choose not to share this data, some features or services may not be available to you.

8. INTELLECTUAL PROPERTY

  • Unless otherwise stated, all materials and content available on the Platform—including source code, databases, features, designs, media assets, and all text or visual elements—are the intellectual property of Magic Play or used under appropriate license. These assets, collectively referred to as “Content” and “Marks,” are protected under copyright and trademark laws, both in the United States and internationally.

  • All Content and Marks are offered strictly for personal, non-commercial use on an “AS IS” basis. No part of the Platform or its content may be copied, reused, modified, distributed, or exploited commercially without prior written consent from Magic Play.

9. LICENSE

A. License to Use the Platform (As a User or Guest)

License Grant:

As long as you meet the eligibility criteria, Magic Play grants you a personal, limited, non-commercial, non-transferable, non-exclusive, and revocable license to access and use the Platform and its content. This license allows you to use and download portions of the Platform’s content solely for personal use and in compliance with these Terms.

This license does not constitute a sale or transfer of ownership. All rights not explicitly granted remain with Magic Play or its licensors.

License Restrictions:

Under this license, you may not:

  • Copy, modify, or alter any part of the Platform;

  • Use the materials for public or commercial gain;

  • Attempt to reverse engineer or extract source code from any of our software;

  • Remove copyright notices or proprietary markings;

  • Share, upload, or mirror content to other platforms or servers.

Violating any of the above may result in termination of this license, and Magic Play reserves the right to delete any downloaded or stored materials from your device upon termination.

B. End User License Agreement (EULA) for Software

If any software we provide is governed by a separate End User License Agreement (EULA), that EULA will dictate the terms of use for such software. In cases where no EULA is provided, the software is licensed under these Terms for personal, non-transferable, and limited use only.

All software is provided “AS IS” without any warranty, and your use is entirely at your own risk.

You may not redistribute or repackage the software unless explicitly permitted under the EULA or these Terms.

C. License for User-Generated Content

We may offer you the opportunity to submit content—such as reviews, comments, feedback, images, text, videos, or other materials (“Contributions”)—to our Platform. These Contributions may be displayed publicly or used by Magic Play without obligation or confidentiality.

By submitting Contributions, you grant Magic Play and its affiliates a worldwide, royalty-free, fully-paid, perpetual, irrevocable license to use, reproduce, modify, publish, translate, create derivative works from, distribute, and display your Contributions across any medium.

You also represent and warrant that:

  • You are the original creator and rights holder of the Contribution, or have legal permission to use it;

  • You have secured all necessary releases and permissions for any individuals shown or identified in your Contribution;

  • Your Contributions do not infringe on the rights of others or violate any applicable law;

  • Your Contributions comply with these Terms and our Prohibited Conduct section.

Magic Play reserves the right to moderate, approve, reject, or remove any Contributions at its sole discretion.

 

10. CONFIDENTIAL INFORMATION

  • Communications between you and Magic Play, as well as content available on our Platform, may contain confidential information belonging to Magic Play. This includes any materials, messages, or data explicitly marked as confidential, or that would reasonably be understood as confidential under the circumstances. If you receive such information, you agree not to share it with any third party without prior written permission from Magic Play.

  • Information will not be considered confidential if it:

    – was developed independently by you without reference to Magic Play’s materials,

    – was lawfully obtained from another source without a confidentiality obligation, or

    – has become publicly available through no action or fault of your own.

  • Disclosure of Magic Play’s confidential information is permitted only when required by law and only if you notify us in advance—unless a court or government authority prohibits such notice.

  • For clarity, the protection of your personal data is covered under our Privacy Policy.

11. NO WARRANTY

a. General Disclaimer of Warranties

  • THE PLATFORM AND SERVICES ARE PROVIDED BY MAGIC PLAY “AS IS” AND “AS AVAILABLE,” WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES. YOUR USE OF OUR PLATFORM IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAGIC PLAY AND ITS AFFILIATES DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THOSE ARISING FROM USAGE OR TRADE PRACTICE. WE DO NOT GUARANTEE THAT THE PLATFORM WILL OPERATE WITHOUT INTERRUPTION, BE ERROR-FREE, OR MEET YOUR REQUIREMENTS.

  • WE DO NOT WARRANT THAT ANY CONTENT OR DOWNLOAD AVAILABLE VIA THE PLATFORM WILL BE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. ANY MATERIAL YOU DOWNLOAD IS AT YOUR OWN RISK, AND YOU ARE FULLY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR LOSS OF DATA RESULTING FROM SUCH DOWNLOADS.

  • Content provided on the Magic Play Platform may include technical, typographical, or visual errors. We do not guarantee the completeness, accuracy, or timeliness of any content and reserve the right to update or correct information at any time without notice.

  • While users may post Contributions to the Platform, Magic Play does not monitor or verify user-generated content. The responsibility for any such content rests solely with the user who provided it. By submitting Contributions, you release Magic Play from any liability relating to those submissions.

b. Games Disclaimer

  • Some games featured on the Platform may not be developed or verified by Magic Play. Downloads from third-party sources such as the Google Play Store are done at your own risk. We are not liable for game functionality or performance.

  • Magic Play does not review or control external websites or third-party content linked on the Platform and does not endorse any third-party games or advertisements. If you click on such links, you do so entirely at your own discretion. Please review the third party’s terms and privacy practices before engaging with their services.

  • MAGIC PLAY EXPRESSLY DISCLAIMS ALL RESPONSIBILITY AND LIABILITY FOR ANY PRODUCTS, SERVICES, OR OFFERS MADE AVAILABLE BY THIRD PARTIES, WHETHER VIA HYPERLINK, ADVERTISING, OR OTHERWISE. ANY TRANSACTIONS YOU ENTER WITH THIRD PARTIES ARE SOLELY BETWEEN YOU AND THEM. YOU SHOULD EXERCISE CAUTION AND USE YOUR BEST JUDGMENT.

c. Country and Availability Disclaimer

  • Magic Play reserves the right to suspend or remove access to the Platform in specific countries based on legal or regulatory obligations. If we determine that operating in your location is not legally viable (including for VPN or proxy usage), your access may be limited or revoked.

  • We do not guarantee uninterrupted availability of the Platform. System failures, maintenance, updates, or external interference may result in service downtime. Magic Play may modify or suspend access to parts or all of the Platform at any time without liability or prior notice.

12. Limitation of Liability and Indemnification

  • To the extent permitted by law, we or our directors, employees, or agents shall not be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the platform, even if we have been advised of the possibility of such damages.

  • Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us during the twelve (12) month period prior to any cause of action arising. In any cases, Magic Play and its suppliers and distributors will not be liable for any expense, loss, or damage that is not reasonably foreseeable.

  • User agrees to defend, indemnify, and hold harmless Magic Play and associated parties against all claims and expenses, including attorneys’ fees, related to any breach of obligations or use of the Services by the user.

13. GOVERNING LAW AND LANGUAGE

Law and Jurisdiction

These Terms, including the arbitration clause, are governed by the laws of the Republic of Türkiye.

If a dispute arises that cannot be resolved amicably, it shall be submitted to arbitration in Bursa, Türkiye, in accordance with the rules of the Istanbul Arbitration Center (ISTAC) effective at the time of the dispute. The arbitration shall be conducted by one arbitrator, and the language of arbitration will be English.

 

14. Miscellaneous Provisions

Severability

If any part of these Terms of Use or related annexes is found to be unlawful, invalid, or unenforceable, that part will be considered separate and will not affect the validity or enforceability of the remaining provisions.

Force Majeure

Neither party will be held liable for delays or failures due to events beyond their control. However, both parties agree that such events do not excuse delays in payment or fees under this Agreement.

Entire Agreement

These Terms of Use represent the complete agreement between you and Magic Play regarding the use of the Platform, and replace all prior or simultaneous agreements on this subject.

Headings

Headings are for convenience only and do not affect interpretation.

Assignability

We may transfer our rights and responsibilities under these Terms to others at any time at our discretion. User accounts cannot be transferred.

Construction

These Terms do not create any third-party beneficiary rights or a partnership, joint venture, or agency relationship between Magic Play and its users.

Electronic Communications

By using the Platform, sending us emails, or submitting online forms, you agree to receive communications electronically. This includes agreements, notices, disclosures, and other communications via email or Platform notifications.

These Terms are written in English. If a translation is provided, it is for convenience only. In case of differences, the English version shall apply. Communication related to this Agreement will also be conducted in English.

No Waiver

If we do not immediately enforce any provision of these Terms, that does not mean we have waived our right to do so in the future.
